FlowSpace Founding Customer Service Agreement

Founding-scope reconciliation: 2026-09-29 — recording remains included; automatic transcription, generated summaries and recent-caller conversational memory are deferred.

Terms of Service — Founding Standard

These Terms govern the paid FlowSpace Founding Standard and any related production onboarding. By affirmatively accepting these Terms on behalf of a business, you confirm that you are at least 18 years old and are authorized to bind that business.

Nothing in these Terms removes rights that applicable law does not allow to be waived.


1. What FlowSpace provides

FlowSpace provides a business-specific inbound AI receptionist.

Depending on the business configuration, the Service can:

  • answer supported inbound business calls;
  • use the business's approved information;
  • communicate in supported English, Hindi and Hinglish modes;
  • answer bounded questions about the business;
  • capture and qualify enquiries;
  • create Leads and callback requests;
  • record appointment intent;
  • use FlowSpace Calendar;
  • create supported Google Calendar bookings when Google Calendar is connected;
  • provide supported call outcomes and recordings in the FlowSpace dashboard.

FlowSpace is not a human receptionist and is not represented as infallible.

The Service is not intended to provide emergency services, safety-critical advice, medical/legal/regulated professional advice, unsupported technical diagnosis, live human transfer, arbitrary web research during calls, customer-controlled outbound cold calling, or guaranteed sales/business outcomes.


2. Founding Standard

The Founding Standard is:

The applicable cycle allowance ends when either the 100-call allowance or 500-connected-minute allowance is reached first.

The two zero-rated calls deduct neither a call nor connected minutes from the paid allowance, but remain subject to the 8-minute maximum.

Unused allowances do not carry forward unless FlowSpace expressly says otherwise.


3. No automatic paid overages

FlowSpace does not silently convert excess use into paid overage charges.

If the applicable allowance is exhausted, additional AI call handling may be restricted until the next paid cycle or until a separate arrangement is expressly accepted.


4. Browser Trial

Where offered, the personalized Browser Trial is a separate pre-purchase environment.

Trial usage, Leads, Calendar data and entitlements do not automatically migrate into the paid production workspace.

The Trial is intended to help evaluate suitability before purchase. It is not a post-purchase money-back guarantee.


5. Customer responsibilities

You must provide and maintain materially accurate business information, including where relevant:

  • services and descriptions;
  • prices;
  • business hours and closure dates;
  • service areas;
  • FAQs;
  • qualification rules;
  • booking instructions;
  • routing/forwarding information.

You must cooperate reasonably with onboarding, testing and troubleshooting.

You must not instruct FlowSpace to mislead callers, make unlawful claims, misuse third-party content, conduct prohibited calling activity, or use the Service unlawfully.


6. Payment

The Founding Standard costs ₹3,499, prepaid.

FlowSpace may accept UPI or another payment method it expressly provides.

A payment screenshot, UTR submission or dashboard payment submission does not by itself mean payment has been verified. FlowSpace may verify actual receipt before proceeding.

FlowSpace is currently not GST-registered and does not charge GST on the ₹3,499 Founding Standard.

FlowSpace will provide a commercial invoice/payment receipt. It is not a GST tax invoice.

If FlowSpace's tax-registration status changes in the future, the applicable invoice/tax treatment may change for future transactions.


7. When the paid cycle starts

Payment does not start the paid billing cycle.

The paid cycle begins only when FlowSpace marks the production workspace:

ACTIVE

This means onboarding and provisioning time does not consume the Customer's paid service period.


8. Provisioning Commitment Point

After payment is verified, FlowSpace will ask you to explicitly authorize production provisioning.

Before that authorization and before FlowSpace begins committing funds/resources to production provisioning, the payment remains in the pre-commitment stage.

Once you authorize production provisioning and FlowSpace begins committing resources, the payment enters the Provisioning Committed stage.

Production commitments may include phone-number rental, telecom/provider funding, routing configuration, cloud/infrastructure preparation and related setup.

No separate setup fee is charged for the Founding Standard; initial provisioning is included within the first-cycle price.

The refund consequences of this point are explained in the FlowSpace Refund & Cancellation Policy.


9. Provisioning and activation

Provisioning can require third-party telecom, cloud and AI services.

Your dashboard may remain in a Provisioning state while the production environment is being prepared and validated.

FlowSpace will not mark the Service ACTIVE until the required production readiness and acceptance checks pass.


10. Recording

Production AI calls are recorded by default. Automatic transcription, generated call summaries, recent-caller context and cross-call conversational memory are not included in the initial Founding Standard.

At the beginning of a production call, the configured receptionist provides a short disclosure in the configured/default call language. A typical English disclosure is:

Hi, I'm [Agent Name], from [Business Name]. This call is recorded to help with your enquiry.

If a caller does not want the call recorded, the founding production phone service does not provide an unrecorded call mode. The caller should use another contact method offered by the business.

A recording can occasionally be unavailable because of provider or technical failure.


11. Phone numbers, routing and forwarding

A FlowSpace-managed phone number may be rented or provisioned through FlowSpace's telecom provider.

A FlowSpace-managed number:

  • is not sold to the Customer;
  • does not become Customer property merely because it is used or published;
  • is not guaranteed to be portable or transferable;
  • remains subject to provider and regulatory availability, lifecycle and reassignment rules.

If you forward your existing business number to FlowSpace, you retain your rights in that number and remain responsible for your originating carrier/account and forwarding configuration.

FlowSpace may assist with forwarding setup but does not control the Customer's carrier network.


12. AI limitations

Real-time AI and speech systems can misunderstand speech, be affected by accent/noise/connectivity, produce an incomplete or incorrect answer, or require human follow-up.

FlowSpace uses approved business information and product safeguards intended to reduce those risks, but does not warrant that every response, Lead field, classification, booking attempt, recording or call outcome will be error-free.

FlowSpace is a first-line receptionist tool, not a substitute for human judgment in exceptional, safety-sensitive, regulated or negotiated situations.


13. Third-party dependencies

FlowSpace relies on third-party services including telecom carriers, cloud infrastructure, AI/model providers and optional Google services.

FlowSpace does not control every outage, maintenance event, carrier failure or third-party interruption.

Brief or isolated third-party interruptions do not automatically create a full-refund entitlement.

FlowSpace will use commercially reasonable efforts to restore or re-provision affected Service where practical.


14. No enterprise SLA

The Founding Standard does not include a guaranteed uptime percentage, enterprise service-level agreement, guaranteed response time or guaranteed disaster-recovery objective.

FlowSpace will use commercially reasonable efforts to operate the Service reliably.


15. Prohibited use

You must not use or attempt to use FlowSpace for:

  • unlawful activity;
  • fraud or deception;
  • spam;
  • unauthorized unsolicited promotional/cold calling;
  • harassment or abuse;
  • bypassing provider/regulatory restrictions;
  • accessing another tenant/business;
  • unlawful collection or processing of data;
  • unauthorized resale;
  • interference with or abuse of the Service.

The founding product does not provide customer-controlled outbound AI calling.


16. Suspension

FlowSpace may suspend all or part of the Service where reasonably necessary because of:

  • non-payment;
  • usage-limit exhaustion;
  • security risk;
  • suspected fraud;
  • prohibited use;
  • provider/regulatory suspension;
  • material breach;
  • threat to other customers or infrastructure;
  • a binding legal requirement.

Where practical and safe, FlowSpace will explain the reason and any available remediation.

Suspension caused by Customer breach or misuse does not create an automatic refund right.


17. Cancellation and termination

Either party may choose not to continue into a future prepaid cycle.

Unless FlowSpace later introduces an automatic-renewal mechanism that you expressly accept, paying for one cycle does not authorize FlowSpace to automatically charge another cycle.

FlowSpace may terminate the Service for material breach, unlawful/abusive use, provider/regulatory requirement, material security/legal risk or permanent discontinuation.

Refunds and remedies are governed by the Refund & Cancellation Policy and applicable law.


18. Privacy

FlowSpace's processing of account, caller, Lead, call, recording, Calendar and related personal data is governed by the FlowSpace Privacy Policy.

By using the Service, the Customer is also responsible for using caller/customer data lawfully and limiting dashboard access to authorized people.


19. Intellectual property

FlowSpace and its licensors retain rights in the FlowSpace software, service architecture, interfaces, AI orchestration, documentation and branding.

The Customer retains rights it otherwise owns in its business information, branding and content.

The Customer grants FlowSpace the limited rights reasonably necessary to host, process and use Customer-supplied information to provide, secure and support the Service, subject to the Privacy Policy and applicable law.


20. No guarantee of business outcomes

FlowSpace does not guarantee revenue, Lead conversion, caller satisfaction, appointment attendance, sales conversion or prevention of every missed business opportunity.

The Customer remains responsible for follow-up, pricing, fulfillment and business decisions.


21. Exclusion of indirect losses

To the maximum extent permitted by applicable law, FlowSpace is not liable for indirect, special, incidental, exemplary or consequential losses, including lost profits, lost revenue, lost opportunity, loss of goodwill or speculative downstream losses.

This clause does not exclude liability that applicable law does not permit FlowSpace to exclude.


22. Limitation of ordinary contractual liability

To the maximum extent permitted by applicable law, FlowSpace's aggregate ordinary contractual liability arising from an affected paid cycle will not exceed the amount actually paid to FlowSpace for that affected cycle.

For the Founding Standard, that amount is normally ₹3,499.

This contractual liability limitation is separate from FlowSpace's ordinary voluntary refund policy.

Nothing here limits liability where applicable law does not permit limitation.


23. Complaints and support

FlowSpace's internal service target is to acknowledge complaints within 48 hours and target resolution within one month.

A complaint or legal threat does not by itself determine whether a refund is due; the underlying facts, the applicable policies and applicable law control.


24. Governing law and disputes

These Terms are governed by the laws of India.

The parties should first attempt in good faith to resolve ordinary disputes through written escalation.

Nothing prevents either party from using a consumer/statutory forum where applicable or exercising another right that cannot lawfully be restricted.

Subject to mandatory jurisdiction rules, ordinary contractual disputes are subject to courts having lawful jurisdiction in Kozhikode District, Kerala.

The founding Terms do not impose mandatory arbitration.


25. Updates

FlowSpace may update these Terms for future cycles or future use.

A newly published version does not retroactively rewrite a completed paid cycle merely because it is newer.

Where a material updated term is intended to apply to a future paid cycle, FlowSpace may require or record acceptance of that updated version.
